Nvidia and AMD Just Turned Export Control Into a Governance Problem

CryptoStack โ€ข โ€ข In-depth

The disclosure line was thin: Nvidia and AMD have intensified their lobbying on China export policy. No timestamp. No figures. No source. A news flash, stripped to a single fact. That thinness is itself the signal. When two rivals who compete for the same CoWoS allocation walk into the White House together, the issue has already escaped the realm of corporate interest and become a question of institutional design.

Governance isn't a hearing schedule or a comment period. It is the set of rules that determines who defines the line between a legal chip and a strategic weapon. That line is currently drawn by the Bureau of Industry and Security using metrics like Total Processing Performance. Every downgraded SKU Nvidia has shipped since the A100 prohibition โ€” H800, then H20 โ€” has been an exercise in reverse-engineering a moving threshold. Based on my 2017 audit work on early Ethereum ICO contracts, I learned a durable lesson: when the ruleset changes faster than the codebase, developers stop optimizing and start guessing. Semiconductor firms are doing the same thing now. The lobbying is not primarily about revenue. It is about the right to plan.

Context: what is actually being governed

Start with the asset under restriction. Nvidia's datacenter flagship silicon is fabricated at TSMC on leading-edge N4/N5 nodes with CoWoS advanced packaging. AMD's MI300 series rides TSMC 5nm with 3D chiplet integration. Neither firm is a fabrication house; both are fabless designers whose manufacturing sits in Taiwan, whose lithography depends on ASML, and whose deposition and etch tools come from Applied Materials, Lam Research, and Tokyo Electron. The chokepoint was never the transistor count. It was the packaging line. CoWoS capacity has been the binding constraint on global AI supply for three consecutive years, and the export control regime has quietly expanded from process nodes to packaging configurations.

The market context matters. Mainland China once accounted for roughly a fifth of Nvidia's datacenter revenue at its peak. That demand did not vanish when the rules tightened; it migrated. Some of it now flows to Huawei's Ascend line and Cambricon's accelerators, some through gray channels, and some simply waits. In a sideways market, capital is starved of direction, and positioning depends on reading which constraints are structural and which are procedural. Export control is procedural โ€” and procedural constraints can be renegotiated. That is precisely why the lobbying spend is rational.

Core: the structure of the negotiation

Three structural facts govern this fight.

First, the technology gap defines the window. Nvidia leads AMD in training compute by roughly one generation, and leads Chinese domestic silicon by an estimated 1.5 to 2 generations at the single-card level. That gap is the entire justification for a control regime: you regulate what is ahead of you, not what is behind. But the gap is a wasting asset. Every quarter a Chinese vendor ships a usable cluster-level system, the regulatory moat narrows.

Second, control manufactures its own opposition. This is the mechanism most commentary misses. Restrictions have handed domestic Chinese vendors a protected home market with guaranteed demand and a strategic mandate funded through mechanisms like the National Integrated Circuit Industry Investment Fund. Export controls are not merely a defensive wall; they are a subsidy to future competitors. Nvidia's most credible lobbying argument is not that regulation hurts Nvidia โ€” Washington does not lose sleep over a 75% gross margin โ€” but that regulation systematically accelerates the erosion of the very lead it is meant to protect. Whether that argument is sincere is irrelevant. Structurally, it is correct.

Third, the alliance is unstable by design. Nvidia and AMD are surface allies in this lobbying cycle, but they compete directly for the same scarce TSMC advanced packaging allocation. If China access is restored, AMD's MI300 line โ€” which never achieved meaningful volume in China โ€” gains an opportunity that Nvidia must defend as aๅญ˜้‡ loss. Their incentives diverge at exactly the moment regulation relaxes. A lobbying coalition built on asymmetric exposure is a coalition built on a schedule.

There is also a financial layer worth naming. Lobbying expenditures are immaterial against either balance sheet. The value is expectation management. Equity markets price policy risk as a discount factor; every credible signal of rule stabilization compresses that discount by more than the lobbying budget by orders of magnitude. Management is not buying access. It is buying optionality on its own valuation.

Contrarian: the paradox Nvidia cannot escape

Here is the trap. If lobbying succeeds and China access reopens under stable rules, Nvidia extends its installed base and slows domestic substitution โ€” but it becomes dependent on a market that has been explicitly designated as a policy lever by the other side, one where countermeasures around gallium, germanium, antimony, and rare earths can be deployed as reciprocal instruments. If lobbying fails, substitution accelerates and the monopoly erodes faster. Either outcome degrades the long-term position; the campaign is a choice between two losses, not a contest for a win.

AMD's calculus is cleaner. For AMD, China is opportunity cost rather than retained revenue, which means AMD can afford a more aggressive posture than Nvidia. The joint appearance masks two different theories of the case. Reading them as a unified industry front is the analytical error most observers will make.

Takeaway: what to watch

The next signal is not the lobbying itself but its timing. Intensified lobbying clusters around rule-change windows: revisions to the AI Diffusion Rule, license decisions on specific downgraded SKUs, and quarterly disclosures in the LDA and OpenSecrets records. Watch three data streams over the next two quarters โ€” China revenue share in earnings calls, BIS rulemaking in the Federal Register, and TSMC CoWoS allocation commentary. Those three will tell you whether the market is moving toward Scenario B: regulated, predictable, suboptimal coexistence.

Every line of code writes a history of power. Every threshold in an export control regulation writes a market structure. The question is not whether the line moves. It is who gets to move it, and how loudly they have to speak to do so.
